Terms of Service

These Terms of Service (“Terms”) govern use of the Whispaw iPhone application, its optional enhanced-trivia connection, and this website (collectively, the “Services”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility and accounts
You must be legally able to agree to these Terms. You are responsible for your device, permissions, paired connections, and activity you start through Whispaw. Protect your device and disconnect a pairing you no longer trust.
2. What Whispaw provides
Whispaw is a hands-free audio companion for voice and text questions, spoken directions, audio tours, trivia, study, location-based Apple Music, and user-started collaborative audio. Compatible AirPods head movements answer trivia, while AirPod presses may control other audio interactions. An optional paired local model may provide enhanced trivia and longer conversational context.
3. Voice, transcription, and generated responses
Speech recognition, transcription, generated responses, and gesture detection can be incomplete or wrong. Review important information and do not rely on Whispaw for medical, legal, safety-critical, emergency, or other high-stakes decisions. You are responsible for what you say, submit, and choose to share.
4. Directions, location, and safety
Directions, nearby information, and audio-tour descriptions may be inaccurate, delayed, or outdated. Always observe traffic, road conditions, signs, laws, and official instructions. Whispaw is designed to reduce screen interaction, not replace attention or judgment. Do not interact with Whispaw when doing so would be unsafe or distracting. Whispaw is not an emergency, roadside, medical, or dispatch service.
5. Trivia and study
Trivia and study content is provided for general educational and entertainment purposes. Questions, answers, scores, local facts, and enhanced-model responses may contain errors. Scores may be reset by reinstalling the app, changing devices, or losing a connection.
6. Apple Music
Location-based music requires compatible Apple Music access and user permission. Catalog availability, playback, subscriptions, library changes, content restrictions, and regional availability are controlled by Apple. Whispaw does not guarantee that a particular artist, recording, era, or location match will be available or exact.
7. Collaborative audio
User-started audio sessions depend on device, network, and communications-provider availability. Participants are responsible for obtaining any consent required before recording or sharing audio. Sessions may disconnect, lose quality, or reach an unintended recipient if contact or routing information is incorrect. Whispaw is not a telephone carrier or emergency calling service.
8. Optional enhanced-trivia connection
Pairing with a local model is optional. The person controlling that model is responsible for its availability, configuration, content, and security. Whispaw does not guarantee that the local relay or enhanced model will remain connected or return a correct response.
9. Acceptable use
Do not use the Services to violate law or third-party rights; harass others; impersonate another person; distribute harmful content; bypass authentication or security controls; interfere with the Services; or access another person’s device, pairing, location, or communications without permission.
10. Third-party services
Apple, mapping and public-information sources, communications providers, relay infrastructure, and any model or transcription provider used for a requested feature are independent third parties. Their terms, privacy policies, eligibility rules, fees, content, and availability apply. Whispaw is not affiliated with or endorsed by them unless expressly stated.
11. Intellectual property and user content
The Services and original Whispaw materials are protected by applicable intellectual-property laws. These Terms grant a limited, revocable, nontransferable right to use the Services as provided. You retain ownership of content you create, subject to the limited permission needed to process, transmit, play, or share an experience you request.
12. Suspension and termination
You may stop using the Services at any time. Whispaw may restrict or terminate access to protect users, providers, or the Services; address abuse or legal requirements; or enforce these Terms.
13. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, OR RESULTS. WHISPAW DOES NOT WARRANT THAT TRANSCRIPTIONS, RESPONSES, DIRECTIONS, TRIVIA, MUSIC, GESTURES, CONNECTIONS, OR AUDIO SESSIONS WILL BE CORRECT OR UNINTERRUPTED.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHISPAW WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF DATA, OPPORTUNITY, GOODWILL, OR CONTENT; PERSONAL DISTRACTION; OR THIRD-PARTY ACTS. WHISPAW’S TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF US $100 OR THE AMOUNT YOU PAID DIRECTLY TO WHISPAW DURING THE 12 MONTHS BEFORE THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.
15. Governing law
These Terms are governed by the laws of California, excluding conflict-of-law principles, except where applicable consumer law requires otherwise.
16. Changes and contact
We may update these Terms as the iPhone application changes. Material changes will be identified by a new effective date and, when appropriate, an in-app notice.
